Public Health Emergency Ends
On Thursday, May 11, 2023, the federally declared Public Health Emergency (PHE) ended. As many flexibilities for physicians and practices were provided by federal regulatory agencies during the PHE, it is important to know which, if any, of those flexibilities will be going away.
Many of the flexibilities provided in the PHE have been extended by Congress through December 2024 (take telehealth services for example). However, there are more health system/facility focused provisions that are expiring. Both the Centers for Medicare and Medicaid Services and the Ohio Board of Pharmacy have drafted these guidance documents outlining some of those expiring provisions:
Additionally, the Drug Enforcement Agency (DEA) issued temporary rules (May 11, 2023) extending pandemic flexibilities in telehealth when prescribing controlled medications through November 11, 2023. Thus, physicians that have already been prescribing controlled medications without an initial in-person visit per the previous rule will still be able to do so.
